Sedentary work, simply considers the physical condition of the person- can they sit most of the time, and walk or stand for brief periods of time. The DOT definition for sedentary work conveniently focuses exclusively on the physical demands and disregards any other aspect such as cognitive.

Consequently the combat veteran’s lay testimony will generally be all that is needed to establish that an in-service stressor actually occurred. This only affects veterans who were actually diagnosed with PTSD while they were still in service. If their PTSD didn’t appear until after service, the normal service connection rules for VA compensation claims apply. Proving a claim of PTSD requires much less evidence with a combat veteran than it would with a non-combat veteran, just like with any other illness or injury that is claimed. By using the sliding scale when processing the claim, the appropriate amount of VA compensation claims can be accurately determined for any veteran who suffers from a service-induced mental disorder.

I purchased inland marine coverage for my restoration equipment. Immediately they made me feel uncomfortable with questions that to me didn’t make sense. Breeze’s claim to fame is that you can get a disability insurance policy 100% online. The company said it uses surveillance to prevent fraud, and that it’s used in less than 5 percent of claims. It added that out of those 5 percent, the surveillance, along with other factors, ends in the cutting off of clients’ disability insurance 30 percent of the time. A doctor hired by the insurance company — who had never met Whitten — said medical records and surveillance video showed he was “physically capable of performing full-time sedentary occupations,” the letter added. And if that risk is too high, an insurance company may deny coverage to an applicant. According to LIMRA, 40 percent of disability insurance applications are either declined, rated, or are only accepted with an exclusion.

The surviving family must just be able to show that the deceased veteran was diagnosed with a disease that is linked to Agent Orange exposure. This could be as simple as sending the VA a copy of the death certificate that lists an Agent Orange-related disease as one of the causes of death. In the 1990s, the VA changed its position on Agent Orange by admitting that certain diseases could be caused by exposure to the chemical. Because of this change in policy, the VA now must pay out previously denied veterans benefits to the qualified families of those soldiers who died from related diseases. Unlike most disability claims applications, this process does not require the child to be formally examined by the VA.

Most states with a PFML program have expanded the definition beyond the immediate, nuclear family. They are solidifying this as a benefit that’s here to stay.

Congress establishes a different maximum amount of pension benefits in each of the three pension programs that the VA can pay a veteran. At the time of your application for pension, the veteran must be permanently and totally disabled. The veteran must pass the “need test,” which means that you must have a limited net worth and income that doesn’t provide you with adequate maintenance. The VA determines financial need using a calculation that takes into account both the veteran’s income and net worth. These payments are designed to compensate for income and resources that these veterans would have accumulated had they not been called to serve their country.

I was placed on LTD in June 2013 following a shoulder surgery. I had complications with the surgery which ended with frozen shoulder. I was re-operated on in Oct. 2013 to release the shoulder and again with immediate PT it became frozen again. For this reason, our disability guide often refers to the insurance company when talking about the Plan. More uncommonly, the proper defendant is the claimant’s employer. A good lawyer knows this is going on and will ensure the proper evidence and expert testimony is in place if the insurance company cherry picks the facts in an attempt to block your claim. Often the medical record alone is not sufficient to completely support an administrative appeal. How the medical evidence is introduced and demonstrated, or how an injury or illness has been described and portrayed is what really makes a difference. Because ERISA regulations must be followed to the letter, and because so many claims fall under ERISA law, insurance companies tend to keep the same administrative appeals process and procedures in place for all claims.
